These Terms govern your use of TenderCheck (the "Service"). By using the Service you agree to these Terms.
1. The Service
TenderCheck reviews tender packs and supporting documents you upload — for example SBD forms (such as SBD 4 and SBD 6.1), CSD records, declarations, certificates and other tender-specific documents — using AI and OCR, and produces a report identifying potential document and administrative risks. Supported checks depend on the document and the tender's requirements. It also lists open South African tender opportunities.
2. No guarantee of responsiveness or award
The Service does not guarantee that any bid will be accepted, deemed responsive, or awarded. Official tender documents and the issuing institution's requirements always take precedence. You are responsible for reviewing the original tender documents and for the accuracy and completeness of your submission.
3. Supported documents and AI/OCR limitations
AI and OCR extraction may occasionally miss or misclassify content, especially where scans are low quality, handwritten, or non-standard. Reports are aids to your own review — they do not replace legal, tax or procurement advice.
4. Payments, refunds and free rescan remedy
Prices are shown in South African Rand and include applicable taxes where indicated. Payments are processed by our payment provider. Because paid scan results and reports are digital services generated and made available immediately, purchases are generally non-refundable, except where a refund or other remedy is required by applicable law. If a scan is materially defective, incomplete, fails to process a supported document, or is affected by a confirmed technical error, TenderCheck may, where appropriate, provide one replacement scan or free rescan as the primary remedy. 5. Acceptable use
You must not upload content you do not have the right to process, attempt to reverse engineer the Service, or use it to violate any law.
6. Intellectual property
The Service and its content are owned by TenderCheck or its licensors. You retain rights in the documents you upload; you grant us a limited licence to process them to provide the Service.
7. Suspension
We may suspend or terminate access for breach of these Terms or where required by law.
8. Liability
To the maximum extent permitted by law, our aggregate liability arising out of or in connection with the Service is limited to the amount you paid for the Service in the three months preceding the event giving rise to the claim.
9. Indemnity
You will indemnify us against third-party claims arising from your unlawful use of the Service or documents you had no right to submit.
10. Governing law
These Terms are governed by the laws of the Republic of South Africa.
11. Changes
We may update these Terms from time to time. Continued use after changes constitutes acceptance.

13. Non-affiliation
TenderCheck is an independent service and is not affiliated with or endorsed by National Treasury, the eTender Publication Portal, CSD, municipalities, state-owned entities or any other procuring institution.
14. Beta service
TenderCheck is currently a beta decision-support tool. Scans may contain errors, omissions, false positives, false negatives or incomplete results. You remain responsible for independently reviewing the tender requirements and your documents before submission. TenderCheck does not guarantee eligibility, compliance, award, acceptance or protection from disqualification. We apply reasonable technical and organisational safeguards, including encrypted HTTPS connections where supported, but do not claim absolute privacy, security, legal compliance or accuracy.
